WEEE/RoHS/REACH Compliance Policy

The European Union Directives 2002/96/EC, as amended, on Waste Electrical and Electronic Equipment (“WEEE”), 2011/65/EU, as amended, on the Restriction of use of Hazardous Substances (“RoHS”) and 1907/06/EC concerning the Registration, Evaluation, Authorization and Restriction of Chemicals (REACH) regulate electrical and electronic equipment put on the European Union Market, including among other things its take-back, recycling, and disposal. Since Harmonic manufactures and provides IT and telecommunications equipment, it will comply with the WEEE and RoHS Directives. Harmonic takes a balanced approach in its product design which includes promoting environmental sustainability and improving product technology, quality, and reliability. Harmonic strives to continuously improve the environmental performance of its products. Harmonic has been working towards compliance with the RoHS Directive for the past number of years, and in doing so, has been working with its suppliers, engineers, and some European technology groups to reduce the number and quantity of hazardous substances in its products. In an effort towards compliance with the RoHS Directive, Harmonic has been asking its third party suppliers to complete an ISO/IEC 17050-1 document certifying RoHS compliance for its components and products. Harmonic Inc. is collecting full material disclosure/content data from all hardware suppliers in order to respond to our customers’ requests regarding REACH environmental compliance data. Receiving full substance content data from our suppliers will eliminate the need for repeated requests. RoHS declarations and laboratory test reports will not meet requirements because they do not provide us with information for all reportable substances. Currently more than 70 REACH regulated substances are reportable and the number of reportable substances is estimated to exceed 130 within the next two years. Use the IPC1752-2, Class 6 Form to report to us the substance data for the products that Harmonic purchases from you. If a supplier is unable to use the attached Form, then Harmonic will accept all of the following as an alternative: 1.If no reportable substances (as per the REACH Directive) in the products supplied to Harmonic, then a declaration certifying no such reportable substances in the products; 2.If applicable, a list of RoHS exemptions used to make the supplied product RoHS compliant; and, 3.All Product Change Notices relating to modifications to the supplied products as associated with environmental regulatory compliance, including any that involve form, fit, or function. Understanding the material content of our products is an integral part of our compliance process and requires cooperative effort with our suppliers. Harmonic bases its knowledge and belief of the material content of its products on information supplied by third parties. Harmonic’s success in obtaining full and accurate information may be limited as a result of some third parties treating certain material as exempt or certain information as confidential and proprietary, or as a result of third party suppliers confining their statements concerning RoHS compliance to the best of their knowledge and belief, applicable only as of a certain date, or as not including component substance information. Harmonic has been marking WEEE in accordance with the WEEE Directive and Harmonic’s Take-Back process for WEEE can be initiated by either an online request form on Harmonic’s website or through an RMA request. Harmonic expects amendments to the Directives, and therefore, Harmonic will continue to work to advance its environmental compliance process and promote environmental sustainability. |
